Agreement Between User and Money Minds
Welcome to Money Minds. The Money Minds website (the "Site") comprises various web pages operated by Money Minds LLC ("M2"). Money Minds is offered to you on the condition of your acceptance, without modification, of the terms, conditions, and notices outlined herein (the "Terms"). Your use of Money Minds signifies your agreement to these Terms. Please read them carefully and retain a copy for your reference.
Service Overview
Money Minds is committed to providing high-quality educational content, personalized support, and a community designed to help students thrive. We encourage prospective students to carefully consider their commitment to their educational journey before joining. Money Minds is specifically designed for individuals dedicated to investing time and effort to achieve meaningful results, rather than for those interested only in "trying out" our offerings. Access to our services is exclusively for members who are committed to these values.
Privacy
Your use of Money Minds is subject to M2’s Privacy Policy. Please review our Privacy Policy, which governs the Site and informs users of our data collection practices.
Electronic Communications
By visiting Money Minds or communicating with M2 electronically, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, notifications, and other communications we provide to you electronically, via email or on the Site, satisfy any legal requirements for written communication.
Your Account
If you use this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account or password. You acknowledge that M2 is not liable for unauthorized access to your account resulting from theft or misappropriation of your credentials. M2 and its associates reserve the right, at our sole discretion, to refuse or cancel service, terminate accounts, or remove or edit content. You are responsible for providing accurate and complete information during registration and for maintaining your account details.
Membership and Payment
Your membership grants you access to an exclusive server for education, mentorship, and a supportive community to network within. By subscribing to Money Minds with a recurring monthly payment, you agree to an initial charge of $49.99, followed by a charge every 30 days thereafter until you cancel. After each successful transaction, you will receive an electronic receipt. We accept online payments in USD (or any agreed-upon currency) via Visa, Mastercard, American Express, and Discover credit or debit cards. To avoid being charged for the following month, please submit cancellation requests before the start of the next billing cycle.
Prohibited Transactions
M2 does not conduct business with, nor provide services to, any countries sanctioned by the Office of Foreign Assets Control (OFAC) in compliance with the laws of Wyoming and the United States.
Children Under Thirteen
M2 does not knowingly collect personal information from individuals under the age of thirteen, either online or offline. If you are under 13, you may use Money Minds only with permission from a parent or guardian.
Cancellation/Refund Policy
You may cancel your membership at any time by logging into your membership portal and adjusting your subscription preferences. Cancellations must be submitted before the next billing cycle to avoid charges for the subsequent month. Due to the digital nature of our offerings and the significant investment in creating and delivering high-quality content, we generally do not offer refunds. However, we understand that exceptional circumstances may arise. If you believe your situation merits a refund, please contact our support team at support@moneymindsapp.com, and we will review your request on a case-by-case basis.
Links to Third-Party Sites/Third-Party Services
Money Minds may contain links to external websites ("Linked Sites"). These Linked Sites are not under the control of M2, and M2 is not responsible for the content of any Linked Site, including any embedded links or updates within these sites. M2 provides these links solely for convenience, and their inclusion does not imply endorsement or affiliation with the operators of the Linked Sites. Certain services available through Money Minds may be provided by third-party sites or organizations. By using any product, service, or functionality originating from the Money Minds domain, you acknowledge and consent to M2 sharing relevant information and data with third parties with whom M2 has a contractual relationship to provide the requested product, service, or functionality on behalf of Money Minds users. You are responsible for complying with the terms of service of any Linked Sites you visit.
No Unlawful or Prohibited Use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use Money Minds in strict accordance with these Terms of Use. By using the Site, you agree that you will not engage in any activity that is unlawful or prohibited by these Terms. You may not use the Site in any way that could harm, disable, overburden, or impair the Site or interfere with other user's enjoyment of the Site. Attempting to obtain materials or information not intentionally provided through the Site is prohibited. All content within the Service—including text, graphics, logos, images, and the compilation of such content, as well as any software used on the Site—is the property of M2 or its suppliers and is protected by copyright and other laws that secure intellectual property and proprietary rights. You agree to respect all copyright and proprietary notices and to avoid altering any such content. You may not modify, publish, transmit, reverse engineer, transfer, sell, create derivative works, or exploit any content on the Site, in whole or in part. M2 content is not for resale, and using the Site does not entitle you to make any unauthorized use of protected content. You agree to use protected content solely for personal, non-commercial purposes, unless you obtain express written permission from M2 and the content’s copyright owner. You do not acquire any ownership rights to protected content, and we grant no licenses, express or implied, to M2’s intellectual property or that of our licensors, except as expressly authorized by these Terms.
Use of Communication Services
The Site may include bulletin boards, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other messaging or communication facilities designed to facilitate communication with the public or within a group (collectively, "Communication Services"). You agree to use these Communication Services solely to post, send, and receive messages and material that are appropriate and relevant to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:
- Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as privacy and publicity rights) of others.
- Publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful topics, names, materials, or information.
- Upload files that contain software or other materials protected by intellectual property laws or by privacy/publicity rights unless you own or control the rights or have obtained all necessary consents.
- Upload files that contain viruses, corrupted files, or any similar software or programs that may harm another's computer.
- Advertise or offer to sell or buy any goods or services for business purposes, unless the Communication Service specifically allows such messages.
- Conduct or forward surveys, contests, pyramid schemes, or chain letters.
- Download any file posted by another user of a Communication Service that you know, or should reasonably know, cannot be legally distributed in such manner.
- Falsify or delete author attributions, legal notices, or proprietary designations or labels of the origin or source of software or other material in uploaded files.
- Restrict or inhibit any other user from using and enjoying the Communication Services.
- Violate any applicable code of conduct or other guidelines related to any particular Communication Service.
- Harvest or collect information about others, including email addresses, without their consent.
- Violate any applicable laws or regulations.
M2 has no obligation to monitor the Communication Services but reserves the right to review materials posted within a Communication Service and to remove any materials at its sole discretion. M2 may terminate your access to any or all Communication Services at any time, without notice, for any reason. M2 also reserves the right to disclose any information as necessary to comply with applicable laws, regulations, legal processes, or governmental requests, and to edit, refuse to post, or remove any materials, in whole or in part, at its sole discretion. Always use caution when sharing any personally identifying information about yourself or your children within any Communication Service. M2 does not control or endorse the content, messages, or information found in any Communication Service and disclaims any liability for the Communication Services and any actions resulting from your participation. Managers and hosts are not authorized spokespersons of M2, and their views do not necessarily reflect those of M2. Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction, and/or dissemination; you are responsible for adhering to any such limitations if you upload materials.
Materials Provided to Money Minds or Posted on Any M2 Web Page
M2 does not claim ownership of any materials you provide to Money Minds, including feedback, suggestions, or other content you post, upload, input, or submit to any M2 Site or its associated services (collectively referred to as "Submissions"). However, by posting, uploading, inputting, providing, or submitting your Submission, you grant M2, its affiliated companies, and necessary sublicensees the permission to use your Submission in the operation of their online business, which includes, but is not limited to, the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat your Submission. Additionally, M2 may publish your name in connection with your Submission. No compensation will be provided for the use of your Submission as outlined herein. M2 is under no obligation to post or use any Submission you provide and reserves the right to remove any Submission at its sole discretion. By posting, uploading, inputting, providing, or submitting your Submission, you represent and warrant that you own or otherwise control all the rights to your Submission as described in this section, including but not limited to all rights necessary for you to provide, post, upload, input, or submit the Submission.
International Users
The Service is controlled, operated, and administered by M2 from our offices within the United States. If you access the Service from a location outside the USA, you are responsible for complying with all applicable local laws. You agree that you will not use the M2 Content accessed through Money Minds in any country or in any manner that violates any applicable laws, restrictions, or regulations.
Indemnification
You agree to indemnify, defend, and hold harmless M2, its officers, directors, employees, agents, and third parties from any losses, costs, liabilities, and expenses (including reasonable attorney's fees) arising from your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement, your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. M2 reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. In such an event, you agree to fully cooperate with M2 in asserting any available defenses.
Class Action Waiver
Any arbitration under these Terms and Conditions will be conducted on an individual basis. Class arbitrations and class, representative, or collective actions are not permitted. The parties agree that claims may only be brought by a party in their individual capacity and not as a plaintiff or class member in any potential class, collective, or representative proceeding, including private attorney general actions. Unless both you and M2 agree otherwise, the arbitrator will not consolidate multiple claims into a single arbitration, nor will the arbitrator preside over any form of representative or class proceeding.
Liability Disclaimer
The information, software, products, and services included in or available through the Site may contain inaccuracies or typographical errors. Changes are periodically added to the information herein. Money Minds LLC and/or its suppliers may make improvements and/or changes to the Site at any time. Money Minds LLC and/or its suppliers make no representations regarding the suitability, reliability, availability, timeliness, or accuracy of the information, software, products, services, and related graphics contained on the Site for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided "as is," without warranty or condition of any kind. Money Minds LLC and/or its suppliers hereby disclaim all warranties and conditions with respect to this information, software, products, services, and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement. To the maximum extent permitted by applicable law, in no event shall Money Minds LLC and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever, including, but not limited to, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the Site, with the delay or inability to use the Site or related services, the provision of or failure to provide services, or for any information, software, products, services, and related graphics obtained through the Site, or otherwise arising from the use of the Site, whether based on contract, tort, negligence, strict liability, or otherwise, even if Money Minds LLC or any of its suppliers has been advised of the possibility of such damages. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. If you are dissatisfied with any portion of the Site, or with any of these Terms of Use, your sole and exclusive remedy is to discontinue using the Site.
Termination/Access Restriction
Money Minds LLC ("M2") reserves the right, in its sole discretion, to terminate your access to the Site and the related services, or any portion thereof, at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Wyoming, and you hereby consent to the exclusive jurisdiction and venue of courts in Wyoming in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. You agree that no joint venture, partnership, employment, or agency relationship exists between you and M2 as a result of this agreement or your use of the Site. M2's performance of this agreement is subject to existing laws and legal process, and nothing in this agreement is intended to restrict M2's right to comply with governmental, court, or law enforcement requests or requirements related to your use of the Site or information provided to or gathered by M2 in connection with such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law, including but not limited to the warranty disclaimers and liability limitations set forth above, the invalid or unenforceable provision will be replaced by a valid, enforceable provision that most closely reflects the intent of the original provision, and the remainder of the agreement will remain in full force and effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between you and M2 with respect to the Site and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and M2 regarding the Site. A printed version of this agreement and of any notice provided in electronic form will be admissible in judicial or administrative proceedings based on or relating to this agreement to the same extent and under the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be written in English.
Changes to Terms
Money Minds LLC ("M2") reserves the right, in its sole discretion, to modify or update the Terms under which Money Minds is offered. The most current version of the Terms will supersede all previous versions. M2 encourages you to periodically review the Terms to stay informed of any updates or changes.
